The Pacific Justice Institute, a public interest law firm headquartered in Sacramento, California, created the OPT OUT Notice. It will help you regain your parental rights and retain parental control over the education and raising of your child. The OPT-OUT Notice warns the school district that they are to follow your instructions regarding the role and teaching of the school in your child’s life.

The Informed Parents OPT-OUT Notice delivery system transmits a fully completed opt-out notice that specifically informs the district that your child will be exempt for the current school year from the following school instruction, programs, and/or activities:​

​​​Attending or participating in any class, instruction or activity related to comprehensive sexual education and HIV/AIDS prevention with the exception of state-mandated Comprehensive ​​​Sexuality Education in seventh grade and one semester in high school.

Participating in any anonymous, voluntary, and confidential test, questionnaire, or survey on pupil health behaviors and risks.

The administration of any questionnaire, survey, examination, or evaluation containing any questions or items relative to my child, or my personal beliefs regarding practices in sex, family life, morality, or religion.

The administration of any examination or assessment relative to my child's, or my personal beliefs or practices in sex, family life, morality or religion, or any question designed to evaluate personal behavioral characteristics, including, but not limited to, honesty, integrity, sociability, or self-esteem.

California State law does not allow a parent to OPT-OUT their child from, “instruction, materials, presentations, or programming that discusses gender, gender identity, gender expression, sexual orientation, discrimination, harassment, bullying, intimidation, relationships, or family and that does not discuss human reproductive organs and their functions.” (§ 51932 (b)). For instance, there is no parental opt-out for discussions of these topics when they occur in humanities, social sciences, or other teaching forums where human anatomy is not also specifically discussed.

Pacific Justice Institute, located in Sacramento, created and legally supports the OPT OUT Notice. The OPT-OUT Notice conforms to California State Law.

In the event a school district does not honor your instruction contained in the Notice, Pacific Justice Institute may work with you to ensure that your wishes are respected by the school and school district.
To opt-out your child:
Follow these steps:​

Fill out all the blank sections on the next page. This will allow Informed Parents to prepare and deliver a properly worded OPT-OUT Notice to your child’s school and school district.

Every blank must be filled out to have a legally binding Notice. We cannot complete and electronically deliver your OPT-OUT Notice unless each blank is fully filled out. (This includes drawing your signature on a smartphone or with your mouse on a computer.)

Upon completion of the following page, the OPT-OUT Notice will be generated and sent by email to the Principal of your child’s school as well as the Superintendent of your child's school district.

You will receive an email copy and a copy will be archived by Informed Parents.

This OPT-OUT Notice must be executed each school year to maintain your child’s OPT-OUT status and protection from the above.

Informed Parents will facilitate the renewal process to keep this OPT-OUT Notice in effect from year to year.
